By entering into this Agreement and granting permission to Yakima Valley Tourism to use your Content, you hereby agree to grant Yakima Valley Tourism and its partners license rights to use your Content as outlined in these terms and conditions. Yakima Valley Tourism also agrees to abide by these terms and conditions. You acknowledge that these terms and conditions constitute legally enforceable promises that you are making to Yakima Valley Tourism and its partners and you also acknowledge that Yakima Valley Tourism is relying on your promises to conduct its business and will incur expenses in doing so. Please read the terms and conditions of this Agreement carefully.
You must be 18 years of age or older and have the legal right to enter into this Agreement and to grant the rights to use your Content, as outlined in these terms and conditions, to Yakima Valley Tourism and its partners.
You warrant that the image, video, audio, graphics, text, or code ("Content") shall be free and clear of any claim, right or encumbrance that would limit or restrict the rights granted to Yakima Valley Tourism and its partners in these terms and conditions and that the use of the Content by Yakima Valley Tourism in accordance with the rights granted to Yakima Valley Tourism shall not violate any copyright, trademark, moral right, right of privacy or right of publicity, or infringe or misappropriate any intellectual property rights of any third party. You warrant that you have all the necessary rights, title and interest to grant the rights set forth in these terms and conditions to Yakima Valley Tourism and its partners.
You warrant that you have obtained model releases for all individuals who appear in the Content, including children under eighteen years of age where release is obtained from their parent or guardian.
You warrant that you are voluntarily providing Yakima Valley Tourism and its partners with the rights to use your Content according to these terms and conditions and will not receive any compensation or payment from Yakima Valley Tourism or its partners for these rights. Neither you nor your successors, heirs, legal representatives and assigns will receive or solicit payment for such rights at any point in time.
You hereby grant to Yakima Valley Tourism and its partners a non-exclusive, perpetual, worldwide, sub licensable, royalty-free license to use, access, load, download, store, install, copy, publish, distribute, communicate, exhibit, produce, reproduce, print, broadcast, display, sub-license and/or assign (hereinafter to "use" or "make use") the Content for non-commercial purposes. Yakima Valley Tourism is under no obligation to use the Content. All rights for use of the Content granted to Yakima Valley Tourism in this Agreement are applicable in any and all media, including but not limited to print, electronic and digital media for advertising, marketing, promotion, education, publicity, public relations and/or editorial purposes. Except for Yakima Valley Tourism's license rights contained in this Agreement, you continue to own all rights in and to the Content. To the extent your Content contains other materials or elements owned by Yakima Valley Tourism or any third party licensors, such as characters or other elements protected by copyright, trademark or other laws, your rights to make use of the Content will continue to be governed by and may be limited by other applicable laws, the rights of third parties and Yakima Valley Tourism.
Yakima Valley Tourism and its partners shall exercise reasonable efforts to include credit to you when using the Content, provided that the details such as your name and/or social media identity (handle) are included by you. You voluntarily agree to waive all moral rights in favour of Yakima Valley Tourism and its partners and under no circumstance shall a failure to include credit by Yakima Valley Tourism its partners, directors, officers, agents, employees or sub licensees constitute a breach of this Agreement.
You shall at all times indemnify and hold harmless Yakima Valley Tourism, its partners, directors, officers, agents, employees and any others for whom it may be responsible in law, from and against all losses, claims, demands, awards, judgments, actions and proceedings by whomsoever made, brought or prosecuted, resulting from or arising out of, attributable to or in any way connected with this Agreement and whether or not caused by your negligence, including without limitation any actions brought by third parties alleging infringement or misappropriation of intellectual property rights in and to the Content, except to the extent to which such loss or damage has arisen out of Yakima Valley Tourism's negligence. You further agree that neither you nor your successors, heirs, legal representatives and assigns will commence proceedings against Yakima Valley Tourism and its partners regarding copyright or moral rights in the Content.
You shall comply with all laws applicable to the performance of your obligations under this Agreement. You agree that all matters relating to this Agreement shall be interpreted in accordance with the laws applicable in Washington State, without reference to its conflict of law provisions, and the parties agree to the exclusive jurisdiction of the Courts of the Washington State. This Agreement shall ensure to the benefit of, and be binding upon, the successors, heirs, legal representatives and assigns of each of Yakima Valley Tourism and you, as applicable.
This Contest is open only to those who enter to win and who are 21 or older as of the date of entry. The Contest is only open to legal residents of the fifty (50) United States and the District of Columbia and is void where prohibited by law. People who reside in other countries, such as Canada are not eligible. Employees of Yakima Valley Tourism, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the "Employees"), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Contest. The Contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
By participating, the Contestant ("You") agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Yakima Valley Tourism as final and binding as it relates to the content of this Contest.
Entries will be accepted online starting on Saturday, March 15, 2025, 8:00 AM PST and ending Saturday, May 31, 2025 at 11:59 PM PST. All online entries must be received by Saturday, May 31, 2025 at 11:59 PM PST.
The Contest must be entered by submitting an entry using the online form provided at https://mailchi.mp/bda71b234d73/taste-wa-giveaway-sign-up-page. The entry must fulfill all Contest requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Yakima Valley Tourism. You may enter only once. You must provide your first and last name, email address and zip code.
You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If You use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of Yakima Valley Tourism.
There will be one prize ("Winner") selected for the giveaway package. The winner will be selected on or about June 2, 2025. The Winner of the giveaway package will receive the following prize package:
Giveaway Package ("Winner") Rosé Revolution Package: A two-night stay at a hotel located in the Yakima Valley, Yakima, WA; Two (2) gift cards, one for breakfast and one for dinner at two (2) different Yakima Valley restaurants with enough value to cover two (2) people for both meals and Two (2) gift cards to two (2) Yakima Valley Wineries for a special winery experience.
In all cases above, reservations must be made in advance with the prize package's contributing partner, and are subject to availability at the time of reservation. Prize nights are valid from June 27, 2025 through June 29, 2025. Some restrictions may apply, per individual sponsor.
Yakima Valley Tourism is not responsible for any arrangements, scheduling, deliverables, or liability associated with the featured Contest packages beyond delivery of the gift cards(s) or prize package components to the verified address or email address of the selected winner.
Estimated retail value of the giveaway prize package is around $700.00. Actual/appraised value may differ at time of prize award. The specifics of each prize shall be solely determined by Yakima Valley Tourism. No cash or other prize substitution shall be permitted. The prizes are non-transferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Winner will be required to complete and submit an affidavit of eligibility; release of liability form and an IRS W-9 form. Acceptance of prize constitutes permission for Yakima Valley Tourism to use giveaway package Winners' names, likeness, and entries for purposes of advertising and trade without further compensation or credit given unless prohibited by law.

There will be four (4) giveaway package Prize winners selected. The prizes will be selected on or about June 2, 2025, by a random drawing from among all eligible entries received under the supervision of Yakima Valley Tourism giveaway package Winners will not be eligible for additional prize drawings once selected. The giveaway package Winners will be notified by email within five (5) days following selection of a Winner for each giveaway package. Yakima Valley Tourism shall have no liability for Winners' failures to receive notices due to spam, junk e-mail, or other security settings or for Winners' provision of incorrect or otherwise non-functioning contact information. If Winners cannot be contacted, are ineligible, fail to claim their prize within three (3) days from the time award notification was sent, or fail to timely return a completed and executed declaration and release as required, the prize may be forfeited, and an alternate potential Winner will be selected randomly from the remaining non-winning, eligible entries. Receipt by giveaway package Winners of the prizes offered in this Contest are conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY A WINNER (AT Yakima Valley Tourism's SOLE DISCRETION) WILL RESULT IN A WINNER'S DISQUALIFICATION AS A WINNER OF THE Contest, AND ALL PRIVILEGES AS A WINNER WILL BE IMMEDIATELY TERMINATED.
Yakima Valley Tourism reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Contest should virus, bug, non-authorized human intervention, fraud, or other cause beyond Yakima Valley Tourism's control corrupt or affect the administration, security, fairness, or proper conduct of the Contest. In such case, Yakima Valley Tourism may select the giveaway package Winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Yakima Valley Tourism. Yakima Valley Tourism reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates these Terms & Conditions. Yakima Valley Tourism has the right, in its sole discretion, to maintain the integrity of the Contest, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Contest rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. Should such an attempt be made, Yakima Valley Tourism reserves the right to seek damages to the fullest extent permitted by law.
By entering, You agree to release and hold harmless Yakima Valley Tourism and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant's participation in the Contest and/or his/her/their acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Contest; (v) electronic or human error in the administration of the Contest or the processing of entries.
THIS Contest IS GOVERNED BY THE LAWS OF the USA AND WASHINGTON STATE, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Contest, participant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Washington State having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney's fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with entering this Contest). Participant further waives all rights to have damages multiplied or increased.

By entering the Contest, your email address will automatically be added to the mailing database. You may choose to opt out of emails from Yakima Valley Tourism at any time. Your email address will not be shared with any other organization or third-party.

The Sponsor of the Contest is Yakima Valley Tourism, located at 10 N. 8th Street, Yakima WA, 98901, USA. Contributors to the prize packages include partners and members of Yakima Valley Tourism. This Contest is hosted by Yakima Valley Tourism is in no way sponsored, endorsed, administered by, or associated with Facebook.
Participation in the Contest constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning the prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein.
